
You’ve likely heard about the National Association of Realtors (NAR) lawsuit settlement, but what does it mean for you? Here’s are the two major impacts of the settlement and how they will affect you as a home buyer or seller.
For Sellers
Traditionally, sellers negotiated a commission with their Realtor®, and the listing agent's brokerage agreed to pay a portion of that commission to the buyer’s broker at closing. This commission was published in the Multiple Listing Service (MLS). However, under the settlement, Realtors® are prohibited from publishing commission details in the MLS. Sellers can still choose to pay the buyer’s agent’s commission. As of 2025 in North Florida, most sellers are agreeing to pay some or all of the buyer's broker compensation.
For Buyers
Every buyer must sign a buyer-broker agreement with their Realtor® before viewing any properties. This agreement clearly outlines the fee the buyer agrees to pay their Realtor® and the duration of the agreement. Both the buyer and the realtor must sign this agreement before a realtor can begin working for any buyer.
